This volume has sprung from concerns about the Access Provisions of the Trade Practices Act.

Part IIIA of the Trade Practices Act resulted from a perception in the 1990’s that the act was not capable of dealing effectively with competition where a single firm was in a dominant position.

Unfortunately the legislation has created greater intrusiveness than originally envisaged. In addition, in some cases the government institutions tasked with administering the legislation have interpreted their role in ways that add even greater intrusion.
